Cool Sailing BCN offers nautical tourism activities — sailing tours of various durations — from Port Olímpic in Barcelona. By making a booking through our website or by phone, the customer accepts these General Booking Conditions in full.

The booking is confirmed only when the customer receives a written confirmation (by email) after completing payment. In the event that a tour cannot be confirmed due to lack of availability, the customer will be informed immediately and a full refund will be issued.

Booking confirmation includes: tour type, date, time, departure point, number of participants and total price paid.

3. Prices and Payment

All prices shown on the website include VAT and any applicable taxes. The prices in force at the time of booking apply.

Payment is made at the time of booking by bank card (Visa, Mastercard, American Express) through the TuriTop booking platform, which processes payments securely via Stripe (PCI-DSS certified). Cool Sailing BCN does not store card details.

In the case of private tours or special bookings requiring a deposit, the specific conditions applicable to each case will be communicated clearly before confirming the booking.

4. Cancellation Policy — By the Customer

Open-group tours (shared)

For shared tours (open to the general public), the following conditions apply:

• Cancellation with at least 24 hours' notice: full refund of the amount paid.
• Cancellation with less than 24 hours' notice: no refund (0%).

To cancel, please contact us by email at info@coolsailingbcn.com or by phone at +34 669 51 00 52. The time of receipt of the cancellation request will be considered for the purposes of the notice period.

Private tours (exclusive boat hire)

For private tours, a sliding-scale cancellation policy applies based on how far in advance the cancellation is made:

Refunds will be processed within 5–10 business days to the same payment method used for the booking.

5. Cancellation by Cool Sailing BCN

Cool Sailing BCN reserves the right to cancel or modify a tour in the following exceptional circumstances:

• Adverse weather conditions (strong wind, rough seas, electrical storms) that make navigation unsafe.
• Restrictions or orders from the Port Authority or Maritime Authority.
• Technical issues with the vessel that cannot be resolved in time.
• Force majeure or unforeseeable circumstances beyond our control.

In any of these cases, the customer will be informed as soon as possible and offered two options:

• Rescheduling: changing the booking to another date, subject to availability, at no additional cost.
• Full refund: 100% refund of the amount paid, within 5–10 business days.

Cool Sailing BCN shall not be liable for any additional costs incurred by the customer as a result of cancellation (travel, accommodation, etc.).

6. Optional Cancellation Insurance

During the booking process, the customer may optionally purchase cancellation insurance through TuriTop, which provides additional coverage for unforeseen circumstances. The specific conditions of this insurance are set by the insurer and are independent of these General Booking Conditions.

Cool Sailing BCN recommends this option for private bookings or when travelling from abroad.

7. Rules on Board

For the safety and enjoyment of all participants, the following rules apply during all tours:

• The captain's authority is absolute on board. Their instructions must be followed at all times with regard to safety and the conduct of navigation.
• The consumption of alcohol brought on board by customers is not permitted without prior authorisation from the captain. The consumption of illegal drugs or substances is strictly prohibited.
• Life jackets must be worn when indicated by the captain or crew, especially by minors and non-swimmers.
• Passengers are responsible for any damage caused to the vessel or its equipment due to negligent or improper use.
• Smoking is permitted only in designated areas and never below deck.
• Waste must not be thrown overboard. Respect for the marine environment is a shared responsibility.
• Cool Sailing BCN reserves the right to refuse boarding or remove a passenger from the boat if their behaviour puts the safety of others at risk, without entitlement to any refund.

8. Minors

Minors under the age of 18 must be accompanied by a parent or legal guardian throughout the activity, who assumes full responsibility for the minor during the tour.

Children under 3 years of age cannot board our boats for safety reasons. We appreciate your understanding.

Cool Sailing BCN may request proof of age documentation in cases of doubt.

9. Complaints and Claims

If you are not satisfied with any aspect of the service, please contact us as soon as possible so we can resolve the issue:

We undertake to respond to any complaint within a maximum of 10 business days from receipt. We also have official complaint forms (hojas de reclamación) available as required by current regulations.

10. Applicable Law and Jurisdiction

These General Booking Conditions are governed by Spanish law, and in particular by Royal Legislative Decree 1/2007 approving the revised text of the General Law for the Defence of Consumers and Users.

For the resolution of any dispute arising from the interpretation or application of these conditions, the parties submit to the Courts and Tribunals of the city of Barcelona, expressly waiving any other jurisdiction to which they may be entitled.

Consumers resident in the European Union may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
